CovertHart Acceptable Use Policy (AUP)
1. Introduction
1.1. CovertHart Network Security Inc. (“CovertHart Networks”) is committed to complying with all applicable laws and regulations governing the use of the internet, email transmission, and network services. This Acceptable Use Policy (“AUP”) is designed to safeguard the integrity, security, and privacy of CovertHart Networks’ services and infrastructure and to ensure that all users (“Customers”) can utilize these services without interference or harassment.
1.2. By using CovertHart Networks' services, including, but not limited to, internet access and network services (hereinafter referred to collectively as “Connectivity Services”), the Customer agrees to comply with this AUP and shall be responsible for ensuring that all of its users also comply. CovertHart Networks reserves the right to modify this AUP at any time, with such modifications becoming effective upon posting to CovertHart Networks’ website. Continued use of the Connectivity Services after any such modification shall constitute acceptance of the modified AUP.
2. Scope
2.1. This AUP applies to all Connectivity Services provided by CovertHart Networks, including those that provide or include access to the internet, hosting services, and services delivered via wireless data networks.
3. Prohibited Activities
The Customer shall not, and shall not permit its users to, use the Connectivity Services for any of the following purposes or activities:
3.1. Illegal Use: Engaging in or facilitating any activity that is unlawful under any applicable law, regulation, or treaty, including but not limited to the dissemination of defamatory, fraudulent, or otherwise unlawful content.
3.2. Security Violations: Engaging in any activity that violates or attempts to violate the security of any network or system, including, but not limited to, hacking, unauthorized access, distribution of malicious software such as viruses or ransomware, or circumventing security protocols.
3.3. Resale of Services: Reselling the Connectivity Services, in whole or in part, without the express prior written consent of CovertHart Networks, except where such resale is expressly permitted under a specific reseller agreement.
3.4. Spam and Email Abuse: Violating the CAN-SPAM Act or any similar legislation governing email communication, including sending unsolicited bulk messages, commercial emails, or chain letters without proper authorization. Engaging in “mail-bombing” or any other activity intended to disrupt or overload the network is strictly prohibited.
3.5. Network Abuse: Engaging in activities that may degrade, interfere with, or disrupt CovertHart Networks’ services, including, but not limited to, denial-of-service (DoS) attacks, excessive bandwidth consumption, or the transmission of harmful or disruptive network traffic.
3.6. Deceptive Marketing and Fraud: Engaging in any fraudulent, misleading, or deceptive practices, including but not limited to “phishing,” falsifying packet headers, or using fraudulent information to obtain services.
3.7. Unauthorized Monitoring: Conducting any unauthorized monitoring of network traffic, intercepting data not intended for the Customer, or attempting unauthorized network scanning, penetration testing, or vulnerability assessments.
3.8. Distribution of Harmful Content: Using Connectivity Services to host, post, or transmit content that is abusive, threatening, obscene, defamatory, or otherwise objectionable, including content promoting violence, racism, or other harmful behavior.
3.9. Child Pornography and Exploitation: Using the Connectivity Services to store, transmit, or distribute child pornography or content related to the exploitation of minors. CovertHart Networks will report any such activity to the appropriate authorities.
3.10. Denial of Service: Engaging in activities intended to disrupt the services or deny access to legitimate users, including but not limited to network overloads or resource exhaustion attacks.
4. Customer Responsibilities 4.1. The Customer is solely responsible for maintaining the security and integrity of its systems, including implementing appropriate security measures such as patches and updates to its operating systems and software. 4.2. The Customer is responsible for all content posted, transmitted, or stored using the Connectivity Services, and CovertHart Networks shall bear no responsibility for such content.
5. AUP Enforcement and Termination 5.1. In the event of any violation of this AUP, CovertHart Networks reserves the right to take such enforcement action as it deems necessary, which may include, but is not limited to, issuing warnings, suspending or terminating the Connectivity Services, or taking legal action as appropriate. 5.2. CovertHart Networks may, at its sole discretion and without prior notice, immediately suspend or terminate services if it determines that the Customer’s activities or the activities of any user:
(i) expose CovertHart Networks to legal liability;
(ii) jeopardize the integrity, security, or normal operation of CovertHart Networks' infrastructure or the infrastructure of any third party;
(iii) interfere with the use of services by other CovertHart Networks customers;
(iv) violate any applicable law, regulation, or court order.
5.3. CovertHart Networks may charge the Customer reasonable fees associated with managing complaints or violations of this AUP, including fees for addressing abuse-related issues.
6. Monitoring and Privacy 6.1. CovertHart Networks may monitor network traffic and use of the Connectivity Services as necessary for maintenance, security, and compliance purposes, in accordance with applicable laws, including but not limited to the Electronic Communications Privacy Act. Customers are advised that communications transmitted through CovertHart Networks’ services are not guaranteed to be private.
7. Copyright Infringement and DMCA Compliance 7.1. The Customer shall not use the Connectivity Services to infringe upon the intellectual property rights of any person or entity, including but not limited to copyright, trademark, or patent rights.
7.2. CovertHart Networks complies with the Digital Millennium Copyright Act (DMCA) and may terminate the services of any Customer found to be a repeat infringer.
8. Incident Reporting 8.1. Complaints regarding violations of this AUP by any CovertHart Networks customer or user should be directed to abuse@coverthart.com. To facilitate the investigation of such complaints, please provide detailed information, including IP addresses, expanded headers, and any relevant log files.
9. Liability Disclaimer 9.1. CovertHart Networks disclaims any and all liability for any content transmitted through its services and for any harm caused by the actions of its users. The Customer shall hold CovertHart Networks harmless for any claims arising from the use of Connectivity Services by the Customer or its users.
Updates to this Page:
CovertHart Networks reserves the right to modify this AUP at any time, with such modifications becoming effective immediately upon posting to the CovertHart Networks website. The Customer’s continued use of the Connectivity Services after such posting shall constitute acceptance of the modified AUP.
