3.2) Unauthorized use of CovertHart’s intellectual property is a crime and is subject to criminal and civil penalties under the laws of the United States of America.

3.3) CovertHart reserves the right to take any necessary legal action to pursue all available remedies for any wrongful use, infringement, or breach of this Agreement.

4) Limitation of Liability

4.1) To the maximum extent permitted by applicable law, in no event shall CovertHart be liable for any direct, consequential, incidental, indirect, special, punitive, or other loss or damage whatsoever or for loss of business profits, business interruption, computer failure, loss of business information, or other loss arising out of or caused by your use of or inability to use the service, even if CovertHart has been advised of the possibility of such damage.

4.2) Your sole and exclusive remedy for any dispute with CovertHart related to the service shall be cancellation of the service.

5) Indemnification

5.1) You agree to defend, indemnify and hold harmless CovertHart, and its officers, directors, agents, employees, subsidiaries and affiliates, and their respective successors and assigns, from and against any and all losses, costs, liabilities, obligations, damages, deficiencies, expenses, actions, suits, proceedings, demands, assessments and/or judgments, including reasonable attorneys’ fees, that are caused by, or result or arise from (i) your use of the site; (ii) any breach by you of any of these site terms; (iii) communications between you, other users, and/or other third parties; and (iv) intellectual property infringement violations and violation of laws by you.
